These Terms and Conditions govern your use of the Mourne Exterior website and the purchase of products from us. By placing an order, you agree to be bound by these terms. Please read them carefully. Nothing in these terms affects your statutory rights as a consumer.
1. About Us
Mourne Exterior supplies outdoor porcelain tiles, paving, and related products. Our registered trading address is 8 Main Street, Hilltown, Co. Down, BT34 5UH, United Kingdom. You can contact us at info@mourneexterior.com or +44 7544 871538.
2. Products and Descriptions
We take care to describe and display our products accurately. However, because porcelain and natural-effect tiles are subject to natural variation, the colour, shade, tone, and finish of the goods you receive may differ slightly from images shown on screen or from samples. Such variation is a normal characteristic of these products and is not a defect. We recommend ordering a sample and purchasing sufficient quantity from the same batch to complete your project, including an allowance for cuts and wastage.
3. Pricing and Payment
Prices are shown on the product pages and are subject to change without notice, although changes will not affect orders we have already accepted. Unless stated otherwise, prices are quoted per the unit shown (for example, per square metre or per pallet) and you are responsible for any applicable delivery charges, which will be shown before you complete your order. Payment must be made in full at the time of ordering using the methods available at checkout.
4. How a Contract Is Formed
Your order is an offer to buy from us. After you place an order you will receive an acknowledgement confirming we have received it; this does not mean your order has been accepted. A binding contract is formed only when we send you confirmation that your order has been accepted or dispatched. If we are unable to fulfil your order, we will contact you and provide a full refund of any sums paid.
5. Delivery
We will deliver to the address you provide at checkout. Estimated delivery times are given in good faith but are not guaranteed. Tiles and paving are typically delivered by pallet to kerbside; it is your responsibility to ensure suitable access and to be available to receive the delivery. Please inspect your goods on arrival.
6. Risk and Ownership
Risk in the goods passes to you upon delivery. Ownership of the goods passes to you only once we have received payment in full.
7. Damaged or Faulty Goods
Please inspect your delivery on receipt. If any goods arrive damaged, incomplete, or faulty, you must notify us as soon as reasonably possible, and in any event within a reasonable time, providing photographs where possible. Under the Consumer Rights Act 2015, goods must be as described, of satisfactory quality, and fit for purpose. Where goods are faulty, you may be entitled to a repair, replacement, or refund.
8. Your Right to Cancel (Consumer Orders)
If you are a consumer, under the Consumer Contracts Regulations 2013 you have the right to cancel your order within 14 days of receiving the goods, without giving a reason. To cancel, contact us at info@mourneexterior.com. You must return the goods to us within 14 days of telling us you wish to cancel. The goods must be unused and in a resaleable condition. You are responsible for the cost of returning the goods unless they are faulty. We will refund the price paid within 14 days of receiving the goods back, or evidence that they have been returned.
This cancellation right does not apply to goods that have been made or cut to your specification or that have been clearly personalised.
9. Returns and Refunds
To arrange a return, please contact us before sending anything back so we can provide instructions. Refunds will be made using the same payment method used for the original purchase. Made-to-order, special-order, and cut items are non-returnable unless faulty.
10. Samples
Samples are provided to give a general indication of colour and finish only. As noted above, natural variation means the bulk product may differ from the sample.
11. Trade Accounts
Trade customers may be subject to additional terms agreed in writing. Where there is any conflict between those agreed terms and these Terms and Conditions, the agreed trade terms will take precedence for trade orders.
12. Intellectual Property
All content on this website, including text, images, logos, and design, is owned by or licensed to Mourne Exterior and is protected by intellectual property laws. You may not reproduce or use any part of it without our prior written permission.
13. Our Liability
We do not exclude or limit our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence or for fraud. Subject to that, we are not liable for losses that were not foreseeable, or for losses arising from incorrect measurements, unsuitable preparation, or improper installation of the products. We strongly recommend that products are fitted by a suitably qualified professional.
14. Events Outside Our Control
We are not responsible for any failure or delay in performing our obligations where this is caused by events outside our reasonable control, including supply shortages, transport disruption, extreme weather, or other unforeseen circumstances.
15. Governing Law
These Terms and Conditions are governed by the law of Northern Ireland, and any disputes will be subject to the exclusive jurisdiction of the courts of Northern Ireland.
